PALMYRA TOWNSHIP – WAYNE COUNTY JUNE 3, 2019
CONDITONAL USE HEARING, PLEDGE AND ROLL CALL OF SUPERVISORS
Chairman Steffen called the Conditional Use Hearing to order at 6:30 PM.
Roll call of the Supervisors showed that Chairman Steffen Supervisor Kmetz and Supervisor Hamby were present.
Chairman Steffen stated the Conditional Use Hearing is for an internet based auto sales business for used cars.
It was verified that the hearing was advertised i n the Wayne Independent on May 21 st and May 29 th , 2019. Paul Natale, Zoning Officer explained that John Catherall came before the Planning Commission requesting a Conditional Use permit to open an internet based auto sales business at 149 Wellwood Avenue, Hawley, Pa. The Planning Commission had seven (7) proposed conditions:
Mr. Natale stated that the client informed the Planning Commission that he had to have a desk, phone and file cabinet and this could not be in his home in order to obtain his license from the state . He went on to say that Mr. Catherall has met all the requirements.
Solicitor Treat suggested that if the Pines Tavern amenities are eliminated the Conditional Use does not survive.
With there being no public comment and with the Solicitor’s suggestion in mind , Chairman Steffen moved into the regularly scheduled June 3rd business meeting.
Supervisor Hamby made a motion to accept the previous month’s minutes as written with a second by Supervisor Kmetz. Supervisor Hamby and Supervisor Kmetz voted yes with Chairman Steffen abstaining since he was not present for the May meeting.
Treasurer’s Report is on file as well as posted on the back wall. Chairman Steffen made a motion to accept the Treasurer’s Report with a second by Supervisor Kmetz and all Supervisors voting yes.
The bills are on file as well as posted on the back wall. Chairman Steffen made a motion to pay the bills with a second by Supervisor Hamby and all Supervisors voting yes.
Police Report was given by Officer Bertholf and is on file.
Fire Report was given by Scott Mead and is on file.
Ambulance Report - None
Street Lights - Supervisor Kmetz stated that the township had received notification from PPL that the 7 new street lights can be installed. He went on to say that the cost for two (2) new transformers was $1,430.00 and the bill to start the process was $174.00. It was noted that both bills had been paid.
Road Report was given by Road Master Kmetz and is on file.
Correspondence - The Township received its normal newsletters, pamphlets, brochures and magazines that are posted on the back wall. The township received the Hawley Area Authority minutes. The Philadelphia Corps of Engineers notified the township that they granted the Tennessee Gas Pipeline Company permission to modify Special Conditions 22 and 23 referring to stream crossings and wetlands.
Zoning Report was given by Mr. Natale and is on file. Mr. Natale stated that in reference to the Bow Tie Lane matter the Magistrate found in favor of the Township as the defendants did not show up for the hearing. He and Bunnell Waste Management met at the property in question to get a price for the cleanup . The price given to bring the property down to wood was $8,900.00. He also stated that PPL would need to be notified to take out the meter. Solicitor Treat stated that what the Magistrate did was found the defendants guilty and scheduled a meeting for damages which is to be held on June 4 th . He went on to say that the defendants will have 30 days to appeal the case. With that being said, Chairman Steffen made a motion to have Solicitor Treat represent the township at the damage hearing on June 4 th with a second by Supervisor Kmetz and all Supervisors voting yes.
Planning Commission - Mr. Natale stated that there nothing to report.
Conditional Use Hearing - Chairman Steffen stated that one more stipulation would be added. It would be Number 8 that the conditional use would not survive if the amenities (bathroom facilities) fail. With that being said Chairman Steffen made a motion to adopt all eight (8) conditions for John Catherall (Solid Motors) with a second by Supervisor Kmetz and all Supervisors voting yes.
Public Comment - None
Emergency Management - Supervisor Hamby stated that there was nothing to report.
Crime Report - Supervisor Kmetz stated there was nothing to report.
Solicitor’s Report - Mr . Treat stated that he had nothing new to report .
Public Comment - None.
Supervisor Hamby made a motion to adjourn at 6: 4 6 PM with a second by Supervisor Kmetz and all Supervisors voting yes.
Next scheduled meeting is July 1 , 2019 at 6:30 PM.
