PALMYRA TOWNSHIP – WAYNE COUNTY OCTOBER 5, 2015

Chairman Steffen called the meeting to order at 7:00 PM.

Roll call of the Supervisors showed that Chairman Steffen, Supervisor Hamby and Supervisor Kmetz were all present.

Supervisor Kmetz made a motion accept the previous month’s minutes and Special Meeting minutes with 2 corrections needing to be made (under Zoning Report last paragraph last sentence change like to look, second correction is on the Special Meeting of September 23, 2015, first paragraph, first sentence on the second page the word (be) needed to be added to the sentence) with a second by Supervisor Hamby and all Supervisors voting yes.

Chairman Steffen stated that after the reading of the bills a brief Executive Session would be held regarding one outstanding situation with the sewer project.

Treasurer’s Report was given by Ms. Powderly and is on file as well as posted on the back wall. Chairman Steffen made a motion to accept the Treasurer’s Report with a second by Supervisor Hamby and all Supervisors voting yes.

The bills were read and are on file as well as posted on the back wall. Chairman Steffen made a motion to pay the bills with a second by Supervisor Hamby and all Supervisors voting yes.

Supervisor Kmetz made a motion to donate the 2 checks totaling $294.80 received from the scrap metal program to the Hawley Community Food pantry with a second by Supervisor Hamby and all Supervisors voting yes.

An Executive Session was called at 7:05 PM and Chairman Steffen reconvened the regular meeting at 7:10 PM.

Attorney Treat stated let the minutes reflect that the Executive Session was to discuss an outstanding issue that was raised by Attorney Waldron on behalf of his client Lakerun Corporation which involved encroachment upon the property of Lakerun Corporation which was done during the initial excavation that was done by Leeward Construction. He went on to explain that a temporary easement was done with Lakerun Corporation to allow the work to continue on the project. Leeward Construction did the restoration work that needed to be done due to excavation on the property. Attorney Waldron has requested attorney’s fees as well as damages for his client from the Township. The Supervisors and Attorney Treat discussed this matter and the resolution has been found which is reasonable.

Chairman Steffen explained that Attorney Waldron had requested $5,000.00 in attorney fees and restitution for his client. He went on to explain that currently the Township is in agreement with Leeward Construction and Justin Hoffman owner of Lakerun Corporation that Leeward Construction will cover the attorney fees of $1,240.00 and the Township would pay Lakerun Corporation $260.00. Chairman Steffen made a motion to accept the stated agreement with a second by Supervisor Kmetz and all Supervisors voting yes.

Police Report was given by Officer Bertholf and is on file.

Chairman Steffen asked if any speed trap work could take place on Columbus Avenue. He stated that complaints have been coming regarding trucks leaving the quarry at high rates of speed.

Fire Report was given by Scott Mead and is on file.

Ambulance Report - None

Road Report was given by Road Master Kmetz and is on file. Road Master Kmetz explained that 325 feet of guide rails are needed on Gravity Road. Two telephone bids were received one was from Chemung Supply in the amount of $4,799.05 and one from Milo Striping in the amount of $6,500.00. Road Master Kmetz made a motion to accept the proposal from Chemung Supply in the amount $4,799.05 with a second by Chairman Steffen and all Supervisors voting yes.

Road Master Kmetz asked about the bonding of roads. Attorney Treat stated that he had a brochure that he would go over with the Supervisors. He stated there is procedure that can be followed for temporary use as well as long term use.

Correspondence - The Township received its normal newsletters, magazine, pamphlets and brochures which are posted on the back wall.

PennDot sent notification that the estimated liquid fuel allocation for 2016 is $59,485.25.

PSAT’s Unemployment Compensation Group Trust Fund notified the Township that the new rate is 2.00% which is down from 2.25%.

Zoning Report was given by Mr. Mynarski and is on file. He stated that the DeGroat Road situation is still out of control and he will talk to Mr. Kuzmiac about the eviction. He explained that Ms. Osborne left a message stating that she would be getting a dumpster on October 9th. Mr. Mynarski said if no dumpster is on her property he would be filing a complaint with the Magistrate on October 13th.

Planning Commission Report - Mr. Mynarski stated there was nothing to report.

Emergency Management Report - Supervisor Hamby stated there was nothing to report.

Crime Watch Supervisor Kmetz stated there was nothing to report.

Solicitor’s Report - Mr. Treat stated he had nothing to report.
